In various official documents, the European Union has declared its goal to pursue a citizen-centric governance of digital transformation. Through a critical review of several of these documents, here we show how “citizen-centric” is more a glamouring than a driving concept. De facto, the EU is enabling a federated data system that is corporate-driven, economic-oriented, and GDPR-compliant; in other words, a Digital Single Market (DSM). This leaves out societal and collective-level dimensions of digital transformation—such as social inclusion, digital sovereignty, and (...) environmental sustainability—which are acknowledged, but not operationalized, by the EU as pillars of a citizen-centric governance. Hence, the door is open to a complementary approach to the governance of digital transformation. We argue that, while a federated data model can constitute the tech-legal backbone of the emerging DSM, a commoning of data, as an ecosystemic approach that maintains a societal and collective outlook by default, can represent a complement to enact a truly citizen-centric governance. The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives and assesses the institutional characteristics of the Equator Principles Association from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of corporations, and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in which nation-states are virtually absent. We argue that (...) Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. ABSTRACT:Profit maximizers have reasons to agree with stakeholder theorists that managers may need to consider different values simultaneously in decision making. However, it remains unclear how maximizing a single value can be reconciled with simultaneously considering different values. A solution can neither be found in substantive normative philosophical theories, nor in postulating the maximization of profit. Managers make sense of the values in a situation by means of the many thick value concepts of ordinary language. Thick evaluation involves the simultaneous (...) consideration of different values: making sense of a value always involves knowing how to engage with it given the other values in the situation. This also goes for profit: maximization is only one way of engaging with the value of profit, and grasping whether maximization is appropriate involves considering other values. We discuss some consequences of our approach for stakeholder theorists and profit maximizers. (shrink)

Enculturation is known to shape the perception of meter in music but this is not explicitly accounted for by current cognitive models of meter perception. We hypothesize that meter perception is a strategy for increasing the predictability of rhythmic patterns and that the way in which it is shaped by the cultural environment can be understood in terms of probabilistic predictive coding. Based on this hypothesis, we present a probabilistic model of meter perception that uses statistical properties of the relation (...) between rhythm and meter to infer meter from quantized rhythms. We show that our model can successfully predict annotated time signatures from quantized rhythmic patterns derived from folk melodies. Furthermore, we show that by inferring meter, our model can better predict the onsets of future events than a similar probabilistic model that does not infer meter. Finally, we demonstrate how our model can be used in a proof-of-concept simulation of enculturation. From this simulation, we derive a class of rhythms that are likely to be interpreted differently by enculturated listeners with different histories of exposure to rhythms. (shrink)

A comparison between the Prolegomena of Chapter II of De iure praedae and the Prolegomena of De iure belli ac pacis leads to the conclusion that the ideas of Grotius on legal systematization have changed considerably between 1604 and 1625. Whereas Grotius starts in IPC with general principles with a rather unclear distinction between leges and regulae, in IBP he gives first the philosophical and theological basis of international law, intertwined by a concise set of general legal rules, mostly derived (...) from Roman law after its reception in Western Europe. The general outlines of legal systematization in the early-modern period are expounded. In the attempts of legal systematization the concept of subjective rights is essential. These subjective rights are not, as is sometimes assumed, a medieval renewal of legal technique, but can be found essentially already in classical Roman law of the first centuries AD.The institutional system is not yet visible in De iure praedae, it might be different for De iure belli ac pacis. Significant here are possibly the expressions ius ad bellum and ius in bello. (shrink)

We report the results of an empirical investigation of the extent to which supernatural believers endorse a porous conception of the mind, i.e., the belief that one’s thoughts can be directly perceived by others. We developed a porous theory of mind scale, tested its factor structure by using both exploratory and confirmatory factor analyses, and showed its relation with supernatural beliefs in three studies in the Netherlands and one study with North-American participants. We found that endorsement of a PToM is (...) positively related to paranormal beliefs. We also showed that the endorsement of a porous view of the mind differs in meaningful ways between people from different religious backgrounds. The finding that supernatural believers endorse a porous conception of the mind fits well with recent work in the field of the anthropology of religion and the psychology of paranormal beliefs. We propose that our PToM scale provides a parsimonious measurement tool that circumvents socially desirable responding, while providing direct insight in the endorsement of paranormal beliefs. Nowadays businesses are often expected to create not just financial, but multiple kinds of value—and they report on this using numbers and narratives. Multiple-value accounting narratives, such as those required by the Integrated Reporting framework, are often met with suspicion: accounting scholars have argued that inconsistencies between narratives and performances show that narratives are used for impression management rather than to accurately report the (ir)responsible behavior of companies. This paper proposes to assess narratives beyond inconsistencies with reported performances. Starting from (...) the idea that performances are delivered in response to the kinds of value in the situation of the company, we argue that narratives and performances should be analyzed together as interrelated elements and considered in relation to the kinds of value in the situation. The paper transforms the common consequentialist view on which value should be “increased,” into the value pluralist view that something being of value can require many different performances such as for example respecting, maximizing, admiring, maintaining, using, and bringing it about. From this perspective, multiple-value accounting narratives logically precede the reporting of performances and should identify the kinds of value in the situation to which the company ought to respond, which performances are required by these kinds of value, and which indicators and targets should be used to report on these performances. A brief analysis of the annual report of Unilever illustrates how such metaethical criteria can help assess and develop multiple-value accounting narratives. (shrink)

BackgroundObtaining informed consent for intravenous thrombolysis in acute ischemic stroke can be challenging, and little is known about if and how the informed consent procedure is performed by neurologists in clinical practice. This study examines the procedure of informed consent for intravenous thrombolysis in acute ischemic stroke in high-volume stroke centers in the Netherlands.MethodsIn four high volume stroke centers, neurology residents and attending neurologists received an online questionnaire concerning informed consent for thrombolysis with tissue-type plasminogen activator (tPA). The respondents were (...) asked to report their usual informed consent practice for tPA treatment and their considerations on whether informed consent should be obtained.ResultsFrom the 203 invited clinicians, 50% (n = 101) completed the questionnaire. One-third of the neurology residents (n = 21) and 21% of the neurologists (n = 8) reported that they always obtain informed consent for tPA treatment. If a patient is not capable of providing informed consent, 30% of the residents (n = 19) reported that they start tPA treatment without informed consent. In these circumstances, 53% of the neurologists (n = 20) reported that the resident under their supervision would start tPA treatment without informed consent. Most neurologists (n = 21; 55%) and neurology residents (n = 45; 72%) obtained informed consent within one minute. None of the respondents used more than five minutes for informed consent. Important themes regarding obtaining informed consent for treatment were patients’ capacity, and medical, ethical and legal considerations.ConclusionThe current practice of informed consent for thrombolysis in acute ischemic stroke varies among neurologists and neurology residents. If informed consent is obtained, most clinicians stated to obtain informed consent within one minute. In the future, a shortened information provision process may be applied, making a shift from informed consent to informed refusal, while still considering the patient’s capacity, stroke severity, and possible treatment delays. Contributions to stakeholder theory often do not systematically deal with the prioritization of stakeholder interests. An exception to this is Reed’s Habermasianapproach to stakeholder management. Central to Reed’s discursive approach is Habermas’s distinction between morality and ethics. Many authors in business ethics argue that, because of its distinction between morality and ethics, discourse ethics is well suited for dealing with the pluralism that characterizes modern society, but also mention complications with the application of this distinction. This paper taps into the (...) vivid debate in political philosophy on Habermas’s distinction between morality and ethics and, on this basis, further elaborates how stakeholder interests should be prioritized from the point of view of discourse ethics. It thus estimates the consequences of the objections against Habermas’s distinction for a discursive approach to the prioritization of stakeholder interests. The conclusion is that, although Habermas’s distinction is not as neat as it may seem, it is not fundamentally challenged and may be successfully applied in the prioritization of stakeholder interests. Hoe moet een democratie omgaan met antidemocraten, wat zijn de bedreigingen van de democratie, en hoe moeten die bedreigingen begrepen worden? Deze vragen staan centraal in het debat over weerbare democratie. Een discussie die aan actualiteit wint door de bedreigingen van religieus extremisme enerzijds en antirechtsstatelijke politieke partijen anderzijds. In dit artikel willen wij aantonen dat het debat over weerbare democratie verdiept kan worden door bestudering van het werk van Claude Lefort en Karl Popper. Het artikel is dan ook niet (...) zozeer een studie van het werk van Lefort en Popper als zodanig, maar in de eerste plaats een bijdrage aan de politiek-filosofische theorievorming over weerbare democratie. We bespreken de elementen in het werk van Lefort en Popper die voor de weerbare democratie relevant zijn. We betogen ten eerste dat zowel Lefort als Popper, om verschillende redenen, zich niet voetstoots laten uitleggen als weerbare democratiedenkers. Ten tweede, dat er, desondanks, in hun werk vruchtbare argumenten voor een weerbare democratie gevonden kunnen worden. En, ten derde, dat het denken van Lefort en Popper belangrijke lessen biedt die de theorie van weerbare democratie kunnen verdiepen. De belangrijkste les in het geval van Lefort is: aandacht voor democratie als samenlevingsvorm, en niet louter als institutie, en daarmee een beter begrip van hoe ons ‘democratisch-zijn’ kan uitmonden in democratische zelfvernietiging. Het denken van Popper kan daarentegen juist de ontsporingen binnen democratische instituties, of breder: het democratische debat, verhelderen. Tot slot probeert dit artikel ook een bescheiden aanzet te zijn tot een nadere bestudering van de samenhang in het werk van twee denkers die doorgaans in isolement bestudeerd worden. (shrink)

Hoe gaan we om met krachten die zich niet aan de regels van onze rechtsstaat houden? 00Steeds meer politieke partijen stellen ongrondwettelijke maatregelen voor, radicale groeperingen trachten door terreur anderen hun wil op te leggen, buitenlandse regimes pogen in onze democratie te interveniëren en lidstaten van de EU nemen wetten aan die de democratie allesbehalve bevorderen. 'De strijd om de democratie' behandelt in het licht van deze ontwikkelingen het vraagstuk van de 'weerbare democratie'. In hoeverre (...) zijn ondemocratische maatregelen geoorloofd om de democratie te beschermen? In deze actuele bundel laten vooraanstaande denkers als Afshin Ellian, Bastiaan Rijpkema, Paul Cliteur, Gelijn Molier en Dirk Verhofstadt hun licht schijnen over deze meer dan urgente vraag. This is a review of van Fraassen's new book, _Scientific Representation_.

The past several generations of scholarship on Rembrandt's “Anatomy Lesson of Dr. Nicolaas Tulp” have suffered from the anxiety of influence exercised by the influential interpretations of William Heckscher and William Schupbach. Schupbach's interpretation in particular has guided interpretation of the painting in the past generation and has given rise to a fundamental misunderstanding of the painting and its cultural significance. Schupbach and those whom he has influenced have failed to recognize that, from the standpoint of Baroque consciousness, there is (...) an inner compatibility rather than a paradox or tension between the optimistic endorsement of earthly science and the putatively pessimistic resignation to the inevitability of death. Where the figure of Tulp represents the optimism of science and technology, that of the topmost surgeon Van Loenen represents the recognition that the technological project functions within the larger context of a Christian worldview. A reflection on the original form of “Tulp,” in which Van Loenen was depicted wearing a hat, shows how Rembrandt's painting can still speak to us from a distance of almost four hundred years and pose a challenge to our own secular ambitions. This paper investigates connectionism's potential to solve the frame problem. The frame problem arises in the context of modelling the human ability to see the relevant consequences of events in a situation. It has been claimed to be unsolvable for classical cognitive science, but easily manageable for connectionism. We will focus on a representational approach to the frame problem which advocates the use of intrinsic representations. We argue that although connectionism's distributed representations may look promising from this perspective, doubts can (...) be raised about the potential of distributed representations to allow large amounts of complexly structured information to be adequately encoded and processed. It is questionable whether connectionist models that are claimed to effectively represent structured information can be scaled up to a realistic extent. We conclude that the frame problem provides a difficulty to connectionism that is no less serious than the obstacle it constitutes for classical cognitive science. (shrink)

In the academic debate on infrastructures in the Global South, there is a broad consensus that (post)colonial legacies present a major challenge for a transition towards more inclusive, sustainable and adapted modes of providing services. Yet, relatively little is known about the emergence and evolution of infrastructures in former colonies. Until a decade ago, most historical studies followed Daniel Headrick’s (1981) “tools of empire” thesis, painting—with broad brush strokes—a picture of infrastructures as instruments for advancing the colonial project of exploitation (...) and subordination of non-European peoples and environments. This paper explores new research perspectives beyond this straightforward, ‘diffusionist’ perspective on technology transfer. In order to do so, it presents and discusses more recent studies which focus on interactive transfer processes as well as mechanisms of appropriation, and which increasingly combine approaches from imperial history, environmental history, and history of technology.There is much to gain from unpacking the changing motives and ideologies behind technology transfer; tracing the often contested and negotiated flows of ideas, technologies and knowledge within multilayered global networks; investigating the manifold ways in which infrastructures reflected and (re)produced colonial spaces and identities; critically reflecting on the utility of large (socio)technical systems (LTS) for the Global South; and approaching infrastructures in the (post)colonial world through entangled histories of technology and the environment. Following David Arnold’s (2005) plea for a “more interactive, culturally-nuanced, multi-sited debate” on technology in the non-Western world, the paper offers fresh insights for a broader debate about how infrastructures work within specific parameters of time, place and culture. In Belgium, as in most countries, each Minister or Secretary is assisted by a limited number of trusted collaborators who constitute the Ministerial Office.The article is an attempt to shed a light on the Chief Ministerial Officer who is the closest collaborator of the Minister.In order to show the role of the Chief Ministerial Officer, the article first describes the tasks, powers and composition of the Ministerial Office to proceed to a more extensive analysis of the functions, the appointment of (...) the Chief Ministerial Officer, and the question whether he can exercise executive power.The most important tasks of the Chief Ministerial Officer are: organization and coordination of the Office and its activities, acting as a «Liaison-Officer» with the Minister, passing on of information, exercising of a form of internal, political and administrative control.The article closes with some more personal remarks, pointing out a few guidelines which a Chief Ministerial Office, should keep in mind. One of the key concepts of Paul Ricoeur’s hermeneutics is the notion of distanciation. In this article we show that Ricoeur introduces this notion as a correction of Heidegger’s focus on being-in and Gadamer’s emphasis on belonging . Ricoeur argues that distanciation does not lead to the uprooting of our belonging to a tradition. Rather, distanciation is an integral part of the dynamics that constitutes tradition. We discuss the different senses in which Ricoeur understands distanciation as a positive and productive (...) aspect of tradition. In particular, we discuss the ontological aspect of distanciation. In his discussion of both the long way of hermeneutics and the creative dimension of distanciation in fiction, Ricoeur argues that it is distanciation that opens up the possibility of understanding our own being-in-the-world. This involvement of distanciation in the disclosure and understanding of being allows us to show that distanciation determines what “kind” of being is understood: what is interpreted in hermeneutics and disclosed in poetics is never being as such, but “being-interpreted” and “being-as,” respectively. This leads us to a description of the difference between Ricoeur’s and Heidegger’s thought concerning the ontological dimension of their hermeneutics. (shrink)
